As a senior ages, writing a legal will with a designated person to act as executor of the will becomes essential. In most states, if a person dies without a will, estate distribution is based on existing state laws. Such laws are based on bloodlines and marriage, but are unable to take into account the quality of these personal relationships. Because of that, many times the final distribution is not what the deceased would have wanted. Writing a will gives legal instruction for what to do with an estate. In addition to a will, a power of attorney is a written authorization to represent or act on another's behalf in private affairs, health decisions, or other legal matters. This document must be witnessed and signed by others.
