1. Additional Terms Applicable to Nanny Concierge Service
In addition to the general Terms of Use (the “General Terms”) applicable to the Care.com Site and Services, the following Additional Terms and Conditions (the “Nanny Concierge Terms”) are provided by Care.com and govern your use of Care.com’s Nanny Concierge Service. The General Terms are incorporated herein by reference. Capitalized terms used herein but not otherwise defined shall have the meanings set forth in the General Terms. The General Terms and these Nanny Concierge Terms are collectively referred to as the Terms. These Terms include the Care.com Privacy Policy, which is incorporated herein. Please read these Terms before using the Nanny Concierge Service. By using the Nanny Concierge Service, you hereby represent, warrant, understand, agree to and accept these Nanny Concierge Terms in their entirety. If you object to anything in these Nanny Concierge Terms, do not use the Nanny Concierge Service.
These Nanny Concierge Terms are subject to change by Care.com at any time. We will notify you about material changes in these Nanny Concierge Terms by sending a notice to the email address registered in your account, or by placing a prominent notice on our Site, so that you can choose whether to continue using the Nanny Concierge Service. Material changes will go into effect no less than 30 days after we notify you. Non-material changes or clarifications will take effect immediately upon posting of the updated Terms. You should periodically check www.care.com/terms for updates. Any use of the Nanny Concierge Service by you after the effective date of any changes will constitute your acceptance of such changes.
2. Description of Nanny Concierge Service
Care.com offers a Nanny Concierge Service through which eligible Care Seekers may, at their discretion, obtain certain consultative services from a Care Specialist (a “Specialist”). These services include:
- A 30-minute consultation with a Specialist to assess the Care Seeker’s and assist with posting a job for caregiving services on the Care.com platform;
- initial reviews of applications to the posted job for relevance to the posted job requirements and, as appropriate, reviews of relevant caregiver profiles;
- searches for other potentially relevant caregivers based on their Care.com profiles within reasonable proximity to the Care Seeker, and, as appropriate, initial communication with such caregivers on behalf of the Care Seeker;
- preparation of a list of potentially relevant caregivers who have either applied to the posted job or who have relevant caregiver profiles and have indicated interest in the posted job;
- assistance with requesting and ordering an Enhanced or Enhanced+MVR Background Check on the Care Seeker’s chosen candidate through the Site; and
- such other services as Care.com may from time to time choose to offer in its discretion.
3. Limitations, Exclusions, and Disclaimers
Care.com may from time to time offer the Nanny Concierge Service either on its own or as part of a paid subscription. If offered as part of a paid subscription, you understand and agree that you will forfeit any unused Nanny Concierge Service benefits at the conclusion of the subscription term, in the event that you cancel your subscription or close your Care.com account, or in the event that Care.com terminates your membership and closes your account pursuant to Section 5 of the General Terms.
The Nanny Concierge service is only suitable for Care Seekers who are looking for typical nanny services for ordinary childcare needs. Such services include, by way of example, child supervision, ordinary snack and meal preparation, light housekeeping and picking up. It is not suitable for finding caregivers for children with special needs, health or medical-related needs, house cleaning or specialized tutoring or educational needs.
Information appearing in a candidate summary reflects the Specialist’s understanding of the Care Seeker’s needs, as well as the results of any research they may perform for the Care Seeker. The Care Seeker maintains the sole and exclusive decision making authority over which caregivers to interview, screen, and/or hire at all times.
Care.com does not perform any background or verifications checks or any Preliminary Member Screens on any corporate Care Providers that may appear in a Care Plan, or on any of their officers, employees or agents.
4. Eligibility to use Nanny Concierge Service
The Nanny Concierge Service is only available to Care Seekers with active Care.com accounts in good standing who have purchased an eligible Membership. Care Seekers must meet and maintain all current requirements for such Membership in Care.com, including without limitation those set forth in Sections 1, 2, 3, 4, 5, and 10 of the General Terms. Registered Users who wish to use the Nanny Concierge Service must meet any verification, vetting, and/or background check requirements that Care.com may from time to time require.
Care.com reserves the right to remove any Registered User’s access to the Nanny Concierge service at any time, for any reason or no reason. You agree that, in the event Care.com removes your access to the Nanny Concierge Service, Care.com has the right, but not the obligation, to notify Care Providers with whom you have communicated about your removal and, at its discretion, the reason(s) therefor.
5. User Responsibilities
The Nanny Concierge Service is solely intended for use by Care Seekers to meet legitimate child care needs. It may not be used for commercial, competitive, or other purposes.
Users of the Nanny Concierge Service are solely responsible for interviewing, investigating, requesting background checks and performing reference checks on, and verifying information provided by, any Care Providers or other care-related businesses that we may present to you in a candidate summary or otherwise. You are responsible for choosing a Care Provider that meets your and your loved one’s needs. 6. No Agency Relationship
Like all Care Providers listed on the Site, any Care Providers who we may present you with via a candidate summary or otherwise through your use of the Nanny Concierge Service are independent third parties and not employees, agents, or servants of Care.com. All Care Providers are solely responsible for setting their rates and fees, and for preforming services directly for you or your loved ones on any terms and conditions that they may specify. Care.com does not train, manage, supervise, or oversee any services provided by any Care Providers, does not set or recommend their rates or fees, does not guarantee their availability or fitness to perform any of the services they advertise, and assumes no responsibility for their conduct, whether on or offline.
You are responsible for complying with all applicable laws in connection with your use of any Care Provider services, including but not limited to laws relating to payments, taxes and the use of insurance products or other third-party benefits to pay for such services.
7. Rules for Use of Nanny Concierge Service
By using the Nanny Concierge Service, you agree to the following rules, in addition to the General Terms:
• You agree to use the Nanny Concierge Service only to find Care Providers for bona fide care needs for your dependent children or for other children for whom you may serve as a legal guardian.
• You agree not to use the Nanny Concierge Service for any unlawful, fraudulent, harassing, or obscene purpose, or for any purpose inconsistent with the General Terms.
• You agree to assume full responsibility for interviewing, vetting, and verifying information provided by Care.com or Care Providers.
• You agree to let Care.com share your full first and last name, and if you are a Care Seeker, the full address of the job, with the other party upon the Care Provider’s acceptance of a requested booking.
• You agree to permit Care.com to send you notifications pertaining to your use of the Nanny Concierge Service by email, SMS, phone, and/or iOS or Android push notification, and you agree to manage the delivery of such notifications via your Account Settings should you no longer with to receive them.
8. Payments
You are solely responsible for paying any Care Provider or care-related business you select for services they provide to you or your family. Care.com accepts no responsibility to pay for any interactions with, or services performed by, Care Providers, whether on- or offline.
