Before your employee begins to work, you need to fill out Form I-9<\/a> to verify they’re eligible to work in the U.S. The I-9 does not get sent to any government agency but must be presented to authorities if your nanny or senior caregiver’s employment eligibility is ever questioned.<\/p>Set up EIN & state tax account(s)<\/h3>
You must first apply for a EIN (Employee Identification Number)<\/a> with the IRS. This will be used as your unique ID with both state and federal tax authorities. Then you can open an account with your state taxing authority.<\/p>Workers’ compensation<\/strong><\/h3>Household employers in New Mexico are not required to get coverage for workers’ compensation insurance<\/a>, however we recommend obtaining coverage. Minimum wage rates<\/h3>- New Mexico state: $12.00\/hour.<\/li>
- Las Cruces city: $13.01\/hour.<\/li>
- Santa Fe city and county: $15.00\/hour.<\/li><\/ul>
Note:<\/em> Whenever more than one rate applies, employers are required to pay the higher rate.<\/p>New Mexico overtime requirements<\/h3>- Live-out employees must be paid 1.5x their hourly rate for all hours worked over 40 in a workweek.<\/li>
- Live-in employees are not required to be paid overtime. <\/li>
- Overtime is not required to be paid when work is performed on a holiday. <\/li><\/ul>
Paid sick leave<\/h3>
Household employers in New Mexico are required to provide up to 64 hours of paid sick leave to their employees each year. Other details of this law are as follows:<\/p>
- Sick leave accrues at 1 hour for every 30 hours worked unless employers wish to allow all 64 hours upfront at the beginning of the year.<\/li>
- Employees can use sick leave for mental or physical medical appointments, medical conditions related to pregnancy or childbirth, illness, injury, or to deal with legal or family issues relating to employee or family members.<\/li>
- Up to 64 hours of unused sick time can roll over to the next year.<\/li>
- Employers are not required to pay out unused paid time off if their employee is terminated. However, if the employee comes back to work within a 12 month period, any unused paid time off must be reinstated unless the employer chose to pay it at the time of termination.<\/li>
- Employers should keep paid time off records for 4 years.<\/li>

Optional benefits for your employee <\/strong><\/h2>Health insurance<\/h3>
Families with only 1 employee can make contributions toward their employee’s health insurance premiums and treat the amount as non-taxable compensation. In this scenario, neither the employee nor the employer are required to pay any taxes on that portion of the compensation.<\/p>
Families with 2 or more employees have 3 options:<\/p>
- Set up an Individual Coverage Health Reimbursement Arrangement (ICHRA).<\/li>
- Set up a Qualified Small Employer Health Reimbursement Arrangement (QSEHRA).<\/li>
- Purchase a policy through SHOP (Small Business Health Options Program). <\/li><\/ol>

Miles driven commuting are not eligible for reimbursement.<\/p>Ending employment <\/strong><\/h2>Termination notice requirement<\/strong><\/h3>Household employers in New Mexico are required to provide their employee with a termination notice that explains their right to unemployment benefits. The notice should be provided when the employee is let go.<\/p>
