Many people have never thought about writing a will, and even fewer actually have one that is current and up to date, but the presence of a legal document instructing relatives on how to settle their estate helps avoid a lot of tension, confusion, and difficulties for a family after the death of a loved one.

What Happens Without A Will?

Estate settlement without a will is a very confusing and multi-stepped process in Texas.  If someone dies without a will, their estate is subject to a set of predetermined distribution laws that divide up property based on family lines, but not family relationships.  If there are no living relatives, the state will take all of the property of the deceased.  These laws are often confusing and are very rigid; without a will the government has complete control over one's estate.
